Shaun is a Partner specialising in construction law and Alternative Dispute Resolution (ADR) within the Dispute Resolution Practice Group.
 

Shaun focuses on construction disputes, handling resolutions through court proceedings, statutory adjudication under the Construction Industry Payment and Adjudication Act 2012, mediation, and arbitration. His construction portfolio includes significant infrastructure projects such as mass rapid transit (MRT), light rail transit (LRT), utilities, refineries, power plants, and motorways. 
 

Shaun is also experienced in managing complex disputes involving telecommunications, real estate, engineering, architecture, design, and quantity surveying.
 

Shaun is empanelled as an arbitrator and mediator at the Asian International Arbitration Centre (AIAC) and as an arbitrator at the Thailand Arbitration Center. He has sat as arbitrator in ad hoc arbitration proceedings and is a Fellow of the Chartered Institute of Arbitrators, Malaysian Institute of Arbitrators and the Asian Institute of Alternative Dispute Resolution.
 

Shaun has represented a variety of clients in Court and statutory adjudication proceedings in Malaysia. He has also represented numerous clients in arbitration proceedings, including those under the International Chamber of Commerce, Singapore International Arbitration Centre, and the AIAC. His expertise includes advising and representing multinational corporations, contractors, and developers in disputes related to bespoke contracts and large-scale infrastructure projects.
 

Shaun was featured on the Legal 500 Southeast Asia Arbitration Powerlist in 2022 and 2023.

Notable Work Highlights
Represented a Korean developer and construction company against a Myanmar-based subcontractor in an ICC arbitration in relation to the construction of a mixed-use development in Yangon.
Represented a leading Myanmar-based media entertainment group against a leading telecommunications service provider in a SIAC arbitration regarding a dispute on the engineering, procurement, construction, and commissioning of telecommunication infrastructure.
Represented a telecommunications construction company in its claim against a Myanmar telecommunications company regarding the construction of cellular towers.
Represented a Myanmar-based conglomerate in the engineering, procurement, construction, and commissioning of oil terminals in Myanmar in a dispute with a Vietnamese-based specialist main contractor.
Represented a main contractor in a dispute involving a bespoke contract for the construction and completion of substructure works for a mixed commercial development.
Represented a specialist contract in a dispute involving a bespoke contract for the provision of skilled labour, materials, tools, equipment, and necessary machinery for the execution and completion of bored piling works for the Mass Rapid Transit Lembah Klang Project.
Represented a main contractor in resisting a claim in a dispute involving a bespoke contract for the design, construction, and completion of all civil and structural works for a 1-million-kilowatt coal-fired power plant.
Represented a developer in resisting a claim in a dispute involving a PAM Contract 2006 for construction and completion of several phases of residential development in Negeri Sembilan.
Represented the main contractor in a dispute involving an Engineering, Procurement, Construction, and Commissioning contract regarding the construction of a Chlorine Dioxide Plant in an AIAC Arbitration. Represented the subcontractor in a dispute involving an Engineering, Procurement, Construction, and Commissioning contract regarding a biotechnology facility which produces propanediol in an AIAC Arbitration.
Represented an architectural consultancy company in a claim for architectural consultancy services against a property investment company. The Federal Court considered whether claims for architectural consultancy services and final account claims fall within the ambit of the Construction Industry Payment and Adjudication Act 2012. (Martego Sdn Bhd v Arkitek Meor & Chew Sdn Bhd and another appeal [2020] 6 MLJ 224)
Represented a Malaysian infrastructure company to oppose a claim for losses as a result of not building a mass rapid transit train station by a property developer in an assessment of damages proceeding after liability had been established. The claimed amount of RM303 million was reduced to RM5.5 million. (Accolade Land Sdn Bhd v Mass Rapid Transit Corporation Sdn Bhd [2024] MLJU 1526)
Represented a main contractor (an unincorporated joint venture construction company) to oppose a quantum meruit claim by a sub-contractor in an appeal to the Court of Appeal. The Court of Appeal considered whether a benefit had been conferred to the main contractor in light of the fact that monies paid to the main contractor were used to rent equipment which was used by the sub-contractor to carry out work and subsequently make a claim against the main contractor.
Represented a sub-contractor (subsidiary of a global integrated energy services and solutions provider) in a dispute involving a bespoke contract regarding mechanical works for an integrated petroleum complex in Johor.
Represented the employer (a Malaysian Federal Government statutory body) in a dispute involving a JKR/PWD contract for the construction of a highway in Johor Bahru. Represented the employer/developer in a dispute involving a PAM standard form of contract for a housing development in Seremban.
Represented a sub-contractor in a dispute involving a PAM standard form of contract for the construction and completion of superstructure works for a strata mixed development in Johor.
Represented a sub-contractor in a dispute involving a bespoke contract for the supply, delivery, erection, and post-tensioning works for the Precast Segmental box girder for the Mass Rapid Transit Project.
Represented a sub-contractor in a dispute involving a bespoke contract for the construction of the Mass Rapid Transit Line 1 from Sungai Buloh to Kajang.
Represented a developer in resisting a claim in a dispute involving a PAM Contract 2006 for rectification work done on reinforced concrete flat roofs for an apartment.
Represented a contractor in a dispute involving a Public Works Department Form 203A (Rev1/2010) for the construction of a flyover leading into a mixed commercial development.
Represented a contractor in a dispute involving a bespoke contract for the construction and completion of a proposed six-storey factory building.
Represented a main contractor in a dispute involving a PAM Sub-contract 2006 contract regarding air conditioning and mechanical ventilation installation works.
