Two crucial amendment bills, namely the Income Tax (Amendment) Bill 2024 and the Labuan Business Activity Tax (Amendment) Bill 2024, were introduced in the Dewan Rakyat for their first reading on 25 March 2024, marking a critical juncture in Malaysia’s fiscal policy. Finance Minister II, Datuk Seri Amir Hamzah Azizan, stressed the importance of these Bills during the session, emphasising their significance for the nation’s economic landscape.
The proposed Income Tax (Amendment) Bill 2024 aims to revise the existing Income Tax Act 1967 (Act 53), focusing on Sections 2, 3, 4, 8, and 9. These amendments, upon enactment, will bring about substantial changes to the taxation framework, impacting various facets of income tax regulation. Notably, Sections 5 and 6 of the Bill have been retroactively implemented from January 1, 2024, indicating a retrospective application, while Section 7 will be applicable for the 2024 assessment year onwards, ensuring immediate action upon enactment.
Concurrently, the Labuan Business Activity Tax (Amendment) Bill 2024 seeks amendments to the Labuan Business Activity Tax Act 1990 (Act 445). These proposed changes, effective from 1 January 2024, underscore the government’s commitment to refining the taxation structure concerning business activities in Labuan. The modifications aim to streamline processes, enhance compliance, and potentially stimulate economic growth within the Labuan jurisdiction.
Currently, as of 27 March 2024, both bills have passed in the Dewan Rakyat and are awaiting approval from the Dewan Negara.
